BEA
BASELINE ENVIRONMENTAL ASSESSMENT (BEA):
Changes adopted in June 1995 to Michigan’s environmental law (Part 201 of the Natural Resources
and Environmental Protection Act, 1994 PA 451, as amended) provide a means of purchasing a contaminated property without assuming
liability for the contamination. The process is known as a Baseline Environmental Assessment (BEA).
We provide qualified personnel and experience to provide our clients with comprehensive services. Our services include:
The BEA is intended to provide and organize information concerning the property's existing contamination so that the contamination
can be readily distinguish from any new releases that might occur after the new owner or operator takes over the property. Three levels
of BEAs (N, D or S) are possible, depending upon the planned future property use.
- Category "N","D" and "S" BEAs.
- Comprehensive Due Care Compliance analysis.
- Follow up compliance evaluation and assistance.
- Category "N": Performed when no regulated substances will be utilized on the property by the new owner; simple format, low cost.
- Category "D": Performed when different regulated substances (other than the contaminants) are to be utilized at the property by the
new owner.
- Category "S": Performed when the same regulated substances are to be utilized at the property. Generally requires complete delineation
of pre-existing contamination and engineering controls.
Due Care Compliance Analysis: In an effort to ensure that contaminated properties are safely redeveloped, Part 201 of the Natural
Resources and Environmental Protection Act, 1994 PA 451, as amended, specifically requires that owners and operators take "Due Care"
measures to ensure that existing contamination does not cause unacceptable risk and is not exacerbated.
Due Care compliance analyses are a common component of a BEA. They provide information and direction to a new owner or operator regarding
their obligations in dealing with the contamination. Due Care requirements are not related to the owner or operators liability for
the contaminants.
